Welcome to FENIXAER.com and the FENIXAER PATH™ platform (collectively, the “Platform”). These Terms of Service (“Terms”) govern your access to and use of the Platform. By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, you may not use the Platform.

1. Nature of the Platform

FENIXAER provides aviation guidance, informational resources, and a matching platform designed to connect aspiring pilots with independent flight instructors, flight schools, aviation colleges, and related service providers.

FENIXAER is not a flight school, training provider, licensing authority, or aviation employer. FENIXAER does not provide flight instruction, issue certifications, guarantee enrollment, or guarantee employment outcomes. All training arrangements, agreements, payments, and instructional relationships occur directly between users and third-party providers.

The FENIXAER PATH™ platform is designed to facilitate alignment and introductions, not to replace independent evaluation or professional judgment.

2. Eligibility

You must be at least 18 years old to use the Platform. By using the Platform, you represent that you have the legal capacity to enter into binding agreements.

If you are using the Platform on behalf of a business, flight school, or institution, you represent that you have authority to bind that entity to these Terms.

3. User Responsibilities

You agree to use the Platform lawfully and responsibly. You agree not to:

• Provide false or misleading information
• Misrepresent qualifications, certifications, or credentials
• Interfere with the Platform’s operation or security
• Attempt unauthorized access to systems or data
• Copy, reproduce, or distribute Platform content without permission

You are solely responsible for the accuracy of information you provide and for decisions you make based on Platform content or introductions.

4. No Guarantees

FENIXAER does not guarantee:

• Acceptance by any instructor, flight school, or college
• Enrollment or scheduling availability
• Training success or certification outcomes
• Employment placement or aviation career advancement

All aviation training decisions, agreements, and outcomes are the responsibility of the parties directly involved.

5. Third-Party Services and Links

The Platform may contain links to third-party services, including but not limited to ground school providers, aviation medical examiners, equipment vendors, or affiliate partners.

FENIXAER does not control or endorse third-party services and is not responsible for their actions, content, policies, or performance. Any transactions or interactions with third parties are conducted at your own risk.

6. Intellectual Property

All content on FENIXAER.com, including text, branding, logos, graphics, platform design, and proprietary processes, is the property of FENIXAER and protected by intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works without written permission.

7. Limitation of Liability

To the maximum extent permitted by law, FENIXAER shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from:

• Use of the Platform
• Training outcomes
• Business decisions made by instructors or schools
• Actions of third-party providers
• Loss of data, income, or opportunity

The Platform is provided “as is” and “as available,” without warranties of any kind.

8. Indemnification

You agree to indemnify and hold harmless FENIXAER, its officers, affiliates, and representatives from any claims, liabilities, damages, or expenses arising from your use of the Platform or violation of these Terms.

9. Termination

FENIXAER reserves the right to suspend or terminate access to the Platform at its discretion if these Terms are violated or if conduct is deemed harmful to the Platform or its users.

10. Modifications

FENIXAER may update these Terms at any time. Updates will be posted with a revised “Last Updated” date. Continued use of the Platform after changes constitutes acceptance of the revised Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to conflict-of-law principles.

Any disputes arising under these Terms shall be resolved in the courts located within that state.
